GENERAL TERMS AND CONDITIONS
The general terms and conditions of the EMO-SHOP EMO-ETT, d.o.o. online store are compiled in accordance with the Consumer Protection Act (ZVPot-UPB2), based on the recommendations of the GZS and international codes for e-commerce.
We advise you to read the Terms of Business written below before using the online store.
By making a purchase, you express your agreement with the terms and conditions listed below. All private data is strictly protected.
The seller reserves the right to change the terms and conditions at any time and without prior notice.
PRICES
All prices are expressed in EUR and include 22% VAT.
Prices are valid at the time of placing the order and do not have a predetermined validity.
Prices are valid until changed and can be changed by the provider without prior notice.
ORDER
By clicking on the “complete purchase” button, the buyer expressly confirms that they agree to pay for the product or service.
The order is stored in electronic form on the seller’s server. After placing the order, the buyer receives an order confirmation to their e-mail address. In the event of an error, the buyer can cancel the order without additional costs within 2 hours of receiving the order confirmation. The buyer must send the order cancellation to [email protected] within two hours of receiving the order confirmation.
If the buyer does not submit an order cancellation within this period, it means that the contract for the purchase of products between the buyer and the seller is irrevocably concluded.
If the cancellation of an individual user’s order is repeated more than three times, the seller reserves the right to terminate their user account.
DELIVERY PRICE LIST
The price is for an unlimited number of items in a single purchase with delivery throughout Slovenia.
Delivery time
Delivery time depends on the shipping speed of the suppliers.
The products are expected to be delivered within 5-7 working days.
The delivery person will call you before the estimated delivery time, so please include a mobile phone number where you can be reached among your contact information.
If you are not at home on the day of delivery, we will arrange another delivery date.

- With Visa, Mastercard payment cards
- Payment with payment cards is possible via the Paywiser payment system. Payment can be a one-time amount or periodic payments. The payment is deducted from the customer upon ordering. You can read more about card payments and the Paywiser payment system at www.paywiser.eu.
The products remain the property of the seller until full payment.
EMO-ETT, d.o.o. issues an invoice by post after delivery or after receiving your product or service, and you will receive it in the package. Later objections regarding the correctness of the issued invoices will not be considered.

RETURN OF GOODS
DESCRIPTION OF THE RIGHT TO WITHDRAW FROM THE CONTRACT:
In the case of contracts concluded at a distance, the consumer has the right to notify the company within 14 days that they are withdrawing from the contract, without having to state the reason for their decision. It is considered that the message is timely if the shipment is submitted within the deadline. The only cost borne by the consumer in connection with the withdrawal from the contract is the direct cost of returning the goods.
If the consumer withdraws from the contract, our company will return all payments made as soon as possible, but no later than 14 days after receiving the notice of withdrawal from the contract. The possibility of withdrawing from the contract for legal entities is not possible. If the consumer has already received the amount or goods and withdraws from the contract, they must return the received goods to the company within 14 days after the notice of withdrawal from the contract.
We kindly ask the consumer to return the goods undamaged, in an unchanged quantity and in the original packaging, to which they attach the form below for exercising the right to withdraw from the contract.
COMPLAINT
The buyer can complain about the goods within eight (8) days of purchase if the goods do not have the properties that the seller expressly promised, if the seller sent the wrong products, products in the wrong quantity or color, or if the products otherwise deviate from the buyer’s order.
In this case, the buyer can request an immediate replacement for the same, flawless product, or within the legally defined period and under the conditions for asserting a claim based on a material defect.
The received goods must be returned undamaged and in an unchanged quantity, in the original packaging with all labels and without signs of use!
Complaints are conditional on the instructions that we enclose with them.
MATERIAL DEFECT
According to the Consumer Protection Act (ZVPot), a defect is material:
if the goods do not have the properties necessary for their normal use or for traffic;
if the goods do not have the properties necessary for the special use for which the buyer is buying them, which was known to the seller or should have been known to them;
if the goods do not have the properties and characteristics that were expressly or tacitly agreed or prescribed;
if the seller handed over goods that do not match the sample or model, unless the sample or model was shown only for notification.
Based on a material defect, the consumer can complain about the defect on the product to the seller within 24 months of receiving the goods. The seller is no longer liable for defects that appear on the product after two years or 24 months from receipt. The buyer can request the elimination of the defect or the replacement of the goods.
PROTECTION OF PERSONAL DATA
The seller respects the applicable legislation on consumer protection, personal data and electronic communication.
The seller undertakes to permanently protect the user’s personal data. The seller will use personal data exclusively for the purposes of fulfilling the order, sending informational material, offers, invoices, prize games and promotions by e-mail or mobile phone.
The user’s data will in no case be given to unauthorized persons.
The user is also responsible for protecting personal data, namely by ensuring the security of their username and password, as well as ensuring adequate anti-virus protection of their computer, or the computer through which they access our online store.
COMPLAINTS AND DISPUTES
The company EMO – ETT, d.o.o. respects the applicable regulations in the field of consumer protection and has an established effective complaint handling system and has a designated person with whom the buyer can contact by phone or e-mail in case of problems. In case of problems, the buyer can turn to tel. no.: 070 468 503. The buyer can submit a complaint to the e-mail address [email protected] or recommended to the address EMO – ETT, d.o.o., Mariborska cesta 86, 3000 Celje. The complaint handling process is confidential.
For all relations and for rights and obligations that are not regulated by these General Terms and Conditions, the provisions of the Obligations Code, the Electronic Commerce on the Market Act, the Personal Data Protection Act and the Consumer Protection Act shall apply mutatis mutandis.

In accordance with legal norms, we do not recognize any provider of out-of-court settlement of consumer disputes as competent for resolving a consumer dispute that a consumer could initiate in accordance with the Out-of-Court Settlement of Consumer Disputes Act.
The provider will confirm receipt of the complaint within five working days and notify the buyer of the progress of the procedure within a further eight days. The provider will do its best to resolve any disputes amicably.
